Welcome to Fitclix! By accessing our website or engaging with our services, you agree to the following Terms and Conditions ("Terms"). Please read them carefully.

Services Provided

Fitclix offers digital marketing services, including web design, SEO, digital advertising, email marketing, and more. Specific deliverables are outlined in client proposals or contracts.

Payment Terms

  1. Fees and Billing:

    • Payments are due according to the schedule outlined in your proposal or invoice. Work will not commence without the initial payment.

    • Late payments are subject to a 10% monthly late fee or the highest amount allowed by law.

  2. Recurring Fees:

    • Monthly services are billed on a recurring schedule. Failure to pay may result in service suspension.

  3. Refunds:

    • Payments are non-refundable once work has commenced. Refunds may be issued solely at Fitclix's discretion if no deliverables have been produced.

Cancellation Policy

  1. Clients may cancel services with 30 days written notice. Fitclix reserves the right to waive the notice period for cancellations mutually agreed upon or under extenuating circumstances."

  2. Cancellation fees may apply for work already completed.

Client Responsibilities

  1. Provide accurate, timely information needed for deliverables.

  2. Approve deliverables within the specified review period to avoid project delays.

  3. Ensure timely access to accounts, platforms, or tools necessary for services.

Limitations of Liability

1. No Guarantees:

While Fitclix employs data-driven strategies, we cannot guarantee specific outcomes, such as increased revenue, leads, or clicks.

2. Indirect Damages:

Fitclix is not liable for indirect or consequential damages, including lost profits.

3. Cap on Liability:

Fitclix's liability for any claim arising out of or related to the services provided is strictly limited to the total amount paid by the client for the specific service in the preceding three months. No additional claims for indirect, incidental, or consequential damages will be entertained.

Termination

Fitclix reserves the right to terminate services in the event of non-payment, violation of these Terms, or any other reasonable cause deemed necessary to protect its business interests.

Intellectual Property

  1. Content created by Fitclix (e.g., designs, campaigns) remains Fitclix’s property until full payment is received.

  2. Clients are responsible for ensuring they have rights to any third-party materials provided to Fitclix for use in projects.

Privacy

Your use of our website and services is governed by our Privacy Policy, which outlines how we collect, use, and protect your data.

Dispute Resolution

Disputes will be resolved through good-faith negotiations. If unresolved, they will be subject to arbitration in Illinois.

Changes to Terms

We reserve the right to update these Terms. Changes will be effective upon posting on our website.
